Where do millions of gallons of fracking waste go and what exactly is in it?  Are you concerned about fracking waste-related earthquakes, spills, leaks, or mechanical failures and their serious implications for the public health, safety, and well-being of our families and our local communities?


If you share these concerns, you are not alone. Central New York State Joins In National Rally Day - At Auburn City Hall

“Freedom from Toxic Fracking Waste: National Rally Day.”

On September 12, 2012 a national coalition of local coordinators and groups in communities across America will hold simultaneous rallies throughout the day to shine light on the numerous problems associated with toxic fracking waste and its disposal, including its links to earthquakes, spills, and leaks.

Come join us Wednesday evening and make some noise about fracking waste. Learn about what is happening even here and now in Cayuga County with the poisons produced by hundreds of existing vertical wells.   Imagine the effects of this waste magnified a millionfold with high volume drilling. 

The Government Office of Accountability paper on Produced Water makes no distinction between conventional and unconventional waste.  The sole distinction is volume. 

Learn about our three active injection disposal wells in NYS - one just 8 miles from Auburn, 3/4 mile from the shore of Cayuga Lake and Montezuma Wildlife Refuge.  Mary Menapace will share what she has learned from EPA documents on particulars of these wells. 

Terry Cuddy will share what is going on with Auburn City Council's recent ban then rescission of the ban on discharging untreated vertical well frackwaste into the outlet of Owasco Lake that ultimately flows to Lake Ontario.  Written info will be available.

Bring signs,  banners, bells, drums, pots and pans and let's make some noise about the frackwaste being sent downstream and injected into the earth in our home right here and now.  

Let's let Auburn City Hall, Governor Cuomo and President Obama know, like other good people across the country,  we will not be sitting still and quiet for the fracking of our home.  We will not allow it.

Dear Governor Cuomo:

"I don't live in New York. But your decision to move forward with the extreme method of extraction known as fracking stands to have direct, irreversible impacts in my state and the community where I currently live - impacts from risks that you yourself have been unwilling to assume in New York, but apparently have no problem outsourcing to Ohio.

"While New York leadership seems anxious to receive the short-term profits fracking might promise, you are rejecting the waste that would invariably be generated and plan to deal with it by shipping it to us - radioactively contaminated drill cuttings, chemically and radioactively contaminated water, even contaminated equipment and solid waste.

"The plan I recently unearthed that's in the works for Ohio, even before you officially lifted your ban, sent me reeling.

"The plan is to ship this waste to my home state (I still have a hard time categorizing previously drinkable water as “waste,” especially in the drought we are experiencing), and haul it (diesel fuel, radiation, hazardous waste components and all) through my drinking water via barge because the trucks the drilling industry has relied upon to haul it up to this point can't deliver it fast enough to suit them. The plan is to barge it to Ohio and then run trucks at industry's convenience through our communities for permanent disposal in landfills and class II injection wells that don't even exist yet.

"Two out-of-state companies from Texas and Pennsylvania are moving forward with these plans; one is already operating without even the formality of permits, regulation, or enforcement.

"If you hear the rumor that Ohio has the best regulations in the nation and are tempted to be placated into believing that we will be kept safe from the risks you are unwilling to accept for your own people based on the professed strength of our regulatory system, please know that the perspective being propagated is by the drilling industry, and not indicative of what citizens are experiencing on the receiving end.

"Even though Ohio has nearly 200 active class II injection wells (how many has New York agreed to accept?), we are being inundated with waste from PA, WV, and TX, to the extent that existing wells are leased to and I believe have exceeded capacity. We have received volumes of out-of-state waste sufficient to induce earthquakes in several areas of Ohio.

"How many earthquakes have New Yorkers had to wake up to at the hands of this hit-and-run, out-of-state industry?

"No homeowner's insurance in Ohio will cover man-made or induced earthquakes. How does that work in New York?

"While you are in the process of approving the generation of even more toxic waste to dump on us, industry is in the process of rushing through 29 more class II injection well permits BEFORE the injection well rules can be passed and BEFORE citizen concerns can be incorporated into the proposed new injection well rules, which would take effect in a few short months.

"Why the rush? Pressure to accommodate more fracking waste that all of the states surrounding us are generating and refusing to provide permanent storage for themselves, at the expense of Ohioans' public health and safety.

"I have always held to what I call the “backyard test.” That is, if you generate or create something too toxic or abhorrent to allow in your own backyard, then you need to reconsider. You have no business putting it in someone else's.

"To do otherwise is an injustice. It is a violation of our most basic human and civil rights.

"If the strength of the testimony I have read that other citizens have submitted to you to warn you of the conditions created in their own communities where fracking has already been committed, or the strength of this letter and others from Ohio based on concerns about the massive amounts of waste to be generated, if this is not sufficient to change your mind about allowing out-of-state drilling companies to frack New York, then as an Ohioan I demand that you find a way to deal with your own waste. Don’t haul it through my drinking water to further poison, sicken, and destabilize communities, farmland, friends, and families here in Ohio.

"This is not commerce, it’s a crime."

"Since 2004, a growing group of citizens has studied deep drilling for natural gas and the proliferation of disposal wells for their toxic waste. With alarm, we have watched Portage County become a huge -- and easy -- target for drilling and dumping.

"Like good citizens, we've relentlessly informed ourselves about fracking. We've been rigorously honest and utterly unmotivated by financial gain. With faith that our warnings would find receptive officials, we have appeared before trustees, mayors, city councils, commissioners, and others, begging for your concern for the disaster that deep drilling and disposal wells most certainly pose.

"We have pointed to serious problems in 10 other states. For example, Pennsylvania reports clusters of well-related health issues: developmental delays, spontaneous bleeding, blisters, rashes, neurological problems and cancer. In Butler County, water runs coal-black from taps, and deer drop dead beside streams they drink from.

"We give you facts impossible to ignore, showing videos and citing references.

"However, you, whom from childhood we have respected with a patriotic love of our country's system of representative government, tell us that since "your hands are tied," your public meetings can't be "platforms" for deep drilling or injection wells. "There is nothing we can do," you have told us, because "state law preempts our power." "Please don't bring this up in our meetings," you say. "We have real problems to discuss."

"We understand: Many of you have leased your own lands to the oil and gas industry. We, too, thought fracking might be a solution for jobs and a cleaner energy. Now as evidence against it escalates around the nation, is it not honorable to admit that you have been mistaken?

"Shockingly, some of you openly state you do not want new information. "Don't give me the facts," you imply, "My mind is made up." Shame on you! You represent us: it is your moral obligation to understand this unproven, dangerously risky technology.

"For those who express concern: Why haven't you led a real fight against this for-profit industry that determines government policy, exempts itself from federal regulations and invades the lands, homes, and health of the residents who rely on you?

"Elected officials, you have the opportunity to act on behalf of caution, the flourishing of the environment, and our children and grandchildren.

"Yes, state law trumps local law for now. However, you can raise your voices against deep drilling and the dumping of toxic wastes that Portage County is experiencing. The state has not preempted your ability to think, learn and choose.

"In Trumbull County, Weathersfield Township and Niles officials have just signed resolutions to ban injection wells. Why did they dare, and why can't you, here in Portage County?"

Why have a national rally on freedom from fracking (hydraulic fracturing) waste?

NEOGAP (Network for Oil & Gas Accountability & Protection, www.NEOGAP.org ) and Frackfree America National Coalition (www.frackfreeamerica.org ) are coordinating a national grassroots rally day on September 12, 2012 to help raise public awareness of what the groups believe are serious risks to public health, safety, and well-being posed by the millions of gallons of toxic fracking waste continually produced by the shale gas and oil drilling industry.

On September 12, 2012 a national coalition of local coordinators and groups in communities across America will hold simultaneous rallies throughout the day to shine a light on the numerous problems associated with toxic fracking waste and its disposal, including its links to earthquakes, spills, and leaks.

Each local group will create their own rally. Sites they may choose include, but are not limited to, sites that are in danger of being fracked or of having an injection well; a public park; a site near city hall; a landfill that accepts toxic frack waste, a river that frack waste is dumped into , and more.

The topic of toxic fracking waste is relevant for the many states who face the possibility or present reality of fracking, which will result in the need to transport and dispose of waste, thereby increasing the chance for spills and leaks.

The topic of where and how to transport and dispose of millions of gallons of fracking waste is not going to just go away.  As more fracking wells are being drilled or permitted, the problem is only getting worse every day.

Serious fracking waste – related problems, including spills, leaks, and other serious accidents and mishaps are facing communities right now – not at some unspecified time in the future.

Because of the immediate needs of communities to protect their public health, safety, and well-being, the issue of the continual creation of, transport of, and disposal of fracking waste needs immediate national and local attention. A solution to the problems associated with fracking waste and acknowledgment and public discussion of these issues needs to take place now.

Fracking waste problems will not go away even if officials misguidedly keep on ignoring it or attempt to minimize its serious risks to public health and safety.  The public needs vital information to make wise decisions regarding their health, safety, and well-being as they relate to fracking and related processes.  The public has inalienable rights to protect the health of themselves, their families, their local communities, and their children and grandchildren.

Having accurate, scientific information is essential in safeguarding the well-being of all communities nationwide.  Various polls show that not enough people even know what fracking is.  We are concerned that the public simply is not getting the information that is crucial for them to make the right decisions regarding fracking waste, fracking and related processes that have serious impacts upon their health, safety, and well-being.

Worse yet, the public is receiving a great deal of information that, we believe, is meant to mislead or to minimize the real risks of fracking waste and fracking and related processes.  

Furthermore, expensive gas and oil industry advertisements paint a rosy picture of fracking and related processes that does not accurately reflect the reality that many people are currently living.  The public needs transparency, honesty, accuracy, and correct information.

These are the reasons why we are having a national rally. One rally goal is to help to get accurate information to the general public and to the officials who represent their constituents.  We want to show the suffering of those affected by fracking waste and its disposal in order to put a stop to the serious problems.

When the public sees how many people are hurting under the system as it stands today, we believe that they also will join with us to present the truth and to effect positive change for ourselves, our families and children, and future generations.

We want people who may feel isolated in their problems related to fracking to know that there are many other like-minded individuals and groups who share their concerns and want to effect positive change for all. 

When we join together, we are able to speak with a louder voice.

What positive steps can we, as a society, take to raise general public awareness?  Who should participate in the national rally?

We are asking that anyone with concerns for the public health, safety and well-being and the safeguarding of our communities consider participating in a local rally and/or signing up to coordinate a local rally in their own city or township.

Mothers, fathers, men and women from all walks of life are welcome to join together in a true grassroots movement.  Some participants in the national rally are experienced in holding rallies and already know what to do.  Don’t worry if you have never had a rally before. For those who want it, we will make step-by-step information available to help you develop your own local rally.

We have compiled a number of links to informative, good videos, articles, and public reports that illustrate concerns with fracking and fracking waste.  We invite you to read through them, view the videos, share them with family and friends and others, and join with us on September 12, 2012 in a national rally day.

We must speak out for our children, our grandchildren and future generations. We cannot leave them the problems that exist now.  Together, we can make positive change.

Important Note About Permits for your Rally:

Getting permits:

It is very important for you to check in your local area about the  laws and ordinances pertaining to  having a rally before proceeding. It is the responsibility of every coordinator to check in their local area to see if a permit is necessary  in order to have a rally.You can do so by calling your local police department, or county officials in the area where you are demonstrating. Normally, they can lead you to the right person to contact. Once you have established who you are supposed to contact, tell them that you are having a rally and ask if a permit is necessary. If so, then ask what procedures you need to follow to get a permit. Getting a permit is a simple procedure. If you are told that you don't need a permit, it is advisable that you ask for a letter stating so. Make sure you keep your permit, or letter stating a permit is not necessary, in your binder. Bring your binder to the rally.
